Terms of sale for Gondwana Green Heat web shop only. Not installation terms.

By trading with Gondwana Green Heat/David Adams, you are agreeing to our Terms and Conditions. We will not uphold any Terms and Conditions imposed upon us unless they have been formally agreed in writing and we have signed to confirm this.

About Us
Gondwana Green Heat is a small online retailer supplying hard to source solid fuel/biomass/ plumbing and heating parts from Northern Europe.

If there is an item you require that is not on our website please contact us giving details of your requirement to enquiries@gondwanagreenheat.co.uk , we will endeavour to forward a quotation to you within 2 business days.

Making Purchases
Firstly browse the online catalogue to find the products you require, once you have found the products you require add them to your shopping basket. You will be asked a few details before the order can be processed.

Gondwana Green Heat reserve the right to not accept your order.

All items purchased in the UK are plus VAT at the standard current rate.

By placing an order you are offering to buy goods from us. We will let you know that we have received your order but this does not mean that your order has been accepted. There is no contract between us until we have accepted your order.

When we have accepted your order, we will confirm this by mail in the form of an invoice with your goods. Keep your confirmation safe in case of any query.

If we are unable to supply you with the goods you require we will contact you with an offer of alternative goods. You do not have to accept this offer and can cancel your order.

Gondwana Green Heat accepts no liability for information obtained from third parties: i.e. part numbers obtained from a manufacturer.

Payment
We accept Visa, Switch, Delta, Solo and MasterCard via paypal on our online shop. Card details are checked and verified by a third party namely paypal and we have no authorisation to take monies from your card/account. We can however refund monies to your card/account.

Shipping Online Payments
Due to the nature of paypal when you place an order, payment will be taken there and then. If for whatever reason we have not received payment, but an order has been received we will contact you.

Pricing
Prices quoted on our website are always inclusive of vat, this means the price you see will have vat added at the checkout. Postage and packaging costs will also be added at the checkout.
From time to time we will have to change the prices of items. This will not affect the status of confirmed orders and in this case you will only pay the price contained in your order confirmation. If the price of an un-confirmed order changes, we will let you know and give you the option of cancelling the order.

Carriage charges will be applied according to the Delivery Address. This can be calculated prior to ordering your items and your shopping cart will update. However if you do not manually update before you proceed this will be done automatically at the checkout. Please ensure you are fully aware of the carriage charges before confirming your order. Sometimes errors occur with postal/ haulage costs if they increase we reserve the right to ask you for the extra monies or refund your money.

Pricing Errors
In the event that there is a pricing error on the website then Gondwana Green Heat will not be bound to honour any orders made at that price.
Guarantee

All our products come with the manufacturers guarantees, extended warranties may be offered via the manufacturer.

Delivery
Most of Gondwana Green Heats products are special orders and will take at least 2 weeks to arrive/ be imported; all items on Gondwana Green Heats web site take at least 7 days to arrive.
All delivery timescales are estimated and NOT guaranteed as this service is provided via a third party.

We accept no responsibility for consequential loss suffered by the Purchaser for delayed or non-delivery of goods. We would advise that all goods are received and checked before booking an installer or ordering other materials to go with our products.

If goods are received damaged or short shipped you must contact the office within 2 working days of receipt. Failure to do so will result in your claim for short shipment or damages to be declined.

If a parcel arrives and is visibly damaged you must sign for the goods as damaged if the carrier will not let you check the items. Alternatively you have the right to refuse delivery of damaged goods. Items not marked as damaged will not be eligible for claims under shipping damages.

Carriage charges will be applied according to the Delivery Address. This can be calculated prior to ordering your items and your shopping cart will update. However if you do not manually update before you proceed this will be done automatically at the checkout. Please ensure you are fully aware of the carriage charges before confirming your order.

IMPORTANT DELIVERY INFORMATION (PLEASE READ CAREFULLY):
Deliveries are carried out by a third party for Gondwana Green Heat

Although they are rare occasional breakages can happen in transit. We advise that all goods are thoroughly checked before accepting delivery, our third party couriers have to allow you time to inspect these items before agreeing to sign for them. For palletised items you have 15 minutes to inspect goods before agreeing to sign for them.

If you feel the item has been damaged in transit or if the packaging is damaged in any way you must either refuse delivery of goods or ensure that you note the goods as damaged when signing for them. Failure to note damage will result in any subsequent claims for damages being declined.

If you accept goods and they are damaged you must notify us that day (Monday-Friday) of delivery. If notification has not been made the day of delivery we cannot be held responsible for these damages.

If you are accepting goods and you find any scuffs, marks, dents etc., (no matter how small) on deliveries please ensure these are marked on the couriers paperwork or handheld computer, failure to do so will result in any claims being declined.

If any goods are refused these will be sent back to Gondwana Green Heat and we will inspect and replace if necessary.

IMPORTANT NOTICE IF YOU ARE NOT SIGNING FOR THE GOODS:
If the goods are being delivered direct to site or being signed for by someone other than yourself you must make them aware of the delivery information above. If the goods are signed for by a third party of yours and they are not checked upon delivery we will not be held responsible for loss or damages

Shipping and Handling
If you wish to collect your products from us, pls contsct us and we will refund you delivery charge, items can be collected from 2 locations, Edinbugh and a depot near Kelso. Pls contact us to arrange a time to collect.

The delivery of goods to you is deemed to be a separate contract for services, distinct from your contract to purchase the goods.

All orders in mainland UK are charged as per the website plus VAT. Some parts of Scotland /Wales/ Highlands will incur a higher charge. If you live outside of the mainland UK the standard carriage charges will not be applicable. You have the option to calculate shipping costs before confirming your order to ensure you still wish to proceed. If you do not manually check shipping costs these will be automatically calculated prior to payment details being required, please ensure you fully understand this calculation before confirming your order as this figure may be higher than originally displayed on the web page. Please note errors sometimes occur with haulage calculations, if we have undercharged you, we will contact you with the additional haulage costs, which you can pay or we will refund you.

If you refuse a delivery with any undamaged items on it you will be charged for the return and the redelivery of those items.

Without prejudice to the statutory rights afforded to consumers, Gondwana Green Heat accepts no liability for any failure to ship products where this results from its inability to do so resulting from acts of god, civil commotion, riots, flood, drought, fire ,traffic police, terrorism, legislation or other factors outside it’s control, or its decision on reasonable grounds not to do so for reasons of suspicion of credit card fraud or similar, provided that it takes all reasonable steps to notify you within fourteen (14) days of order placement that products will not be shipped as ordered.

Returns Policy

General Return Conditions

We will only accept returns for goods within 28 days of purchase.

All returns must be notified to Gondwana Green Heat by email or in writing.

You must provide your original order number and invoice/despatch note number when emailing our returns department.

Shipment discrepancies must be notified within 2 days, failure to do so may result in a claim for missing goods being declined.

If Goods are supplied in a clear sealed bag and are not right at the time of delivery do not open the sealed bag as this will invalidate any returns for goods no longer required
We suggest that you take out carrier insurance on any items you send back to us

Goods No Longer Required:
If goods are purchased and no longer required you must contact our returns team via Email.

All goods returned to us due to not being needed or the wrong product ordered etc., will be subject to a 25% restocking charge.

If your goods have been received in a sealed bag do not open this as it will invalidate your return request.

Any goods returned to us which have been fitted but is not faulty will not receive a refund

Some Electrical items are non refundable due to their nature (for example: Printed Circuit Boards) and others may need to be tested for re-sale. In this instance the manufacturer may charge an additional testing charge.

If you are uncertain if the items required are fit for purpose then please contact our sales team before purchasing, they will also be able to advise on any special terms imposed by the relevant manufacturer before ordering.

It is your responsibility to return these goods to us in a re-saleable condition. Please do not damage or write on any packaging as this may invalidate your refund. We suggest that you take out carrier insurance on any items you send back to us.

All thermal stores , buffer tanks, accumulator tanks, expansion vessels cannot be returned unless faulty, all these products are made to order and are usually despatched directly from the manufacturer.

Damaged or Faulty Goods
If items are received damaged or faulty you must email us immediately we will then ask for a pictures/ information. Details of faults or damage must be supplied at the time of contact. All goods must be returned within 14 days of contacting us.

Due to the nature of the goods we supply damaged or faulty items may require testing by the manufacturers before a replacement or refund can be issued.

All thermal stores, buffer tanks, accumulator, expansion vessels must be checked using compressed air within 2 days of delivery. Special attention must be paid to pressure limitations of the product and must only be performed by a qualified engineer only.

If goods have arrived damaged or faulty you must inform us that day. If the packaging looks damaged when goods are being signed for you must sign for the goods as ‘Damaged’. If the delivery driver will not accept this you have the right to refuse the delivery. Failure to identify the items as damaged with the courier may result in a claim for shipment damage to be refused.
If items are reported as faulty under manufacturer’s warranty (usually 12 months) we have to take into account the manufacturer’s terms. Some manufacturers have Engineers who will repair the products and others offer to replace or refund faulty items. When manufacturers replace or refund items they often require the faulty item back to inspect, in this instance you may be required to return the faulty item before a replacement is sent out to you. If a replacement is required immediately this will need to be purchased and we will request a credit only for the returned goods. If the goods returned to us are found to be not faulty, or damaged due to misuse we reserve the right to invoice you for these goods. Within 6 months we will provide proof of our analysis on this inspection.

Items reported faulty within 14 days under the Consumer Sales of Goods Act may be replaced within this period Free of Charge subject to satisfactory return of the suspected faulty item. This applies to small and medium sized products and is at our discretion. If the suspected faulty item cannot be returned a replacement will not be sent. After the first 14 days a suspected faulty item must be returned to Gondwana Green Heat, and we reserve the right to repair, replace or refund the item. This will not apply to certain products, including thermal stores, water heaters, buffer tanks, accumulator tanks and expansion vessels.

Please note the price you pay for the new replacement item may be a higher price than you paid for the original item.

Items that require testing will need to be sent to the manufacturers and a test report will be completed. Timescales for this process will differ for each manufacturer.
If your item is tested by the manufacturer and proven not faulty we reserve the right to charge for return carriage and any testing fees applied by the manufacturer. In this instance you would be supplied with full test details from the manufacturer/ Gondwana Green Heat. Please note that if your item is over 6 months old it is your responsibility to prove the goods are faulty, some manufacturers may ask for this before testing items.

Carriage for returning faulty items may be covered by the manufacturers, they may wish to collect your item or offer to refund any return postage incurred by you. Please do not send any items back unless we have confirmed to do so as you may not receive your costs back.

Please note that as we are just a distributor for various products and NOT the Product Manufacturer we do not offer cover for sub-sequential loss arising from damaged or faulty goods, please ensure that all goods are inspected before being installed. We will where possible give advice to try and rectify any faults in your system and it is up to you if you wish to carry out any advice we give but we do not offer compensation for any claims arising for sub-sequential loss. This includes claims for hours lost whilst replacing faulty items or testing to ascertain if the product we have supplied is actually faulty. We would always recommend that you call/email us for advice on faulty items before replacing or returning as some manufacturers may investigate and resolve any issues themselves.

Gondwana Green Heat accepts no liability for damage to items caused by misuse, faulty installation or goods that have not been used for their intended purpose.
Your Rights Under The Consumer Protection (Distant Selling) Regulations (DSR)

Applicable to consumers only
You have an unconditional right to cancel your order within seven working days from the day of delivery. PLEASE NOTE: You must take reasonable care of the goods during the cancellation period.
To cancel your order under the DSR:

Send an email ,or write to us telling us you wish to cancel the order, we will then provide you with a address to return the items. We request that all goods are returned within 14 days of informing us.

Please remember, thermal stores, buffer tanks, accumulator tanks, expansion vessels cannot be returned, they are ordered / made to order. Please ensure you are ordering the correct product and if unsure please contact us.

Parcel up the items you are returning with the Goods Return Note securely to minimise any damage that may be caused during delivery. Please include a copy of your notification of cancellation or order confirmation so we can trace your order quickly

Return the items to us via an appropriate carrier. PLEASE NOTE that returning goods under the cooling-off period allowed by the Distance Selling Regulations is at your cost unless we have supplied alternative goods that you have not found acceptable.

We would recommend that all goods are sent back by a recorded and insured means as we do not cover any damages or loss for goods in transit when being returned to us.

Once you have notified us of your intention to cancel the contract we will refund you the cost of your order as soon as we can. This will always be within 30 days of your cancellation.

PLEASE NOTE: Outbound carriage will not be refunded as this is classed as a service and not goods. As the delivery of goods to you is deemed to be a separate contract for services, distinct from your contract to purchase the goods.

This section is for consumers only who purchased items for private use. Business to business sales are carried out under our Terms & Conditions.

Privacy Policy
Gondwana Green Heat will not disclose any buyer’s information to third parties. Cookies are used on our site, but these are only used to keep track of your shopping basket content when you select an item. All information is collected in accordance with the data protection act 1998.

This site may contain links to other sites on the Internet that are owned and operated by third party vendors and other third parties (the “external sites”). Gondwana Green Heat is not responsible for the availability of, or the content located on or through, any external site, nor for any transactions between you and such sites (including as to ‘cookies’, personal data, confidential information, or purchases of goods or services). You should contact the site administrator or webmaster for those external sites if you have any concerns regarding such links, content or transactions.

Publication of Comments Online
You agree that we can publish any comments that you send to us concerning the quality of our service or products on our website. We may use your name and town of residence, but we will not publish your email address, telephone number, website address or street address.

We aim to exceed our customer expectations as often as possible, however there may be rare occasions when a customer feels that they have not been treated fairly. If this is the case you agree that before posting any negative comments on any website, newsgroup, blog or other online resource you agree to write to the customer services team explaining the problem and allow them 14 days to investigate and resolve the problem and/or respond in writing. If you are still unsatisfied then you agree to include the customer services reply in any online publication you make, to provide any readers with a balanced view.

Needless to say publication of negative material that is untrue will result in an action for libel against the publisher.
